These Terms of Use ("Terms") are an agreement between you and Gemspire Insurance Solutions, doing business as Insure Health Plans / Compare Healthcare Insurance Plans ("we," "us," "our"), a licensed insurance agency at 701 Palomar Airport Rd, Ste 330, Carlsbad, CA 92011. They govern your use of insurehealthplans.com (the "Site") and any form you submit on it. By using the Site or clicking "Submit" (or a similar button), you agree to these Terms and our Privacy Policy, which is part of these Terms. If you do not agree, please do not use the Site.
THESE TERMS INCLUDE A BINDING ARBITRATION AGREEMENT AND CLASS-ACTION WAIVER (SEE "DISPUTES" BELOW).
We are an independent insurance agency. Our licensed agents help you compare and apply for health, dental, vision, Medicare and related insurance from the insurance companies we are appointed with. We do not offer every plan available in your area. We are compensated by insurance companies when you enroll in a plan through us, at no added cost to you. We do not sell or rent your information to lead buyers, other agencies or marketers.
Submitting a form is a request for information. It is not an application for insurance, and it does not bind any coverage. Quotes and plan details shown on the Site are estimates; final rates, eligibility and benefits are set by the insurance company and stated in its policy documents.
If you check the consent box on a form, you agree that we and our licensed agents may contact you at the phone number and email you provided about health, dental, vision, Medicare and related insurance. This includes calls and texts made with automated technology, artificial or prerecorded voice (including AI-generated voice), and prerecorded voicemail messages that may be left without your phone ringing, even if your number is on a state or federal Do-Not-Call list. Consent is not a condition of any purchase; you can call (800) 939-3330 instead.
If you do not check the box, we may still contact you about the specific request you submitted, by email or by a call or text from an agent that does not use an automated system or prerecorded voice.
Message frequency varies. Message and data rates may apply. You can revoke consent at any time by any reasonable means, including replying STOP to a text, telling an agent on a call, calling (800) 939-3330, or emailing info@insurehealthplans.com. We will honor your request promptly. Reply HELP for help.
You agree to provide true, accurate information about yourself and anyone you include on a form, and to submit information only for yourself or people who have authorized you to do so. You may not use the Site to submit another person's phone number without their permission, interfere with the Site, or copy its content for commercial use.
Content on the Site is general information about insurance. It is not legal, tax, medical or financial advice. Speak with one of our licensed agents about your situation.
We do not offer every plan available in your area. Any information we provide is limited to those plans we do offer in your area. Please contact Medicare.gov or 1-800-MEDICARE (TTY 711), 24 hours a day, 7 days a week, for information on all of your options. We are not connected with or endorsed by the U.S. government or the federal Medicare program.
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not guarantee that the Site will be error-free or uninterrupted.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, OFFICERS, EMPLOYEES AND AGENTS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SITE. WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY RELATED TO THE SITE IS LIMITED TO $100. Some states do not allow these limits, so they may not apply to you. Nothing here limits our duties to you as your licensed insurance agent under state insurance law.
Except where prohibited by law, you and we agree that any claim relating to the Site, these Terms, any consent you gave us, or our communications with you will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in San Diego County, California, or by phone or video if the claim is $2,500 or less and you choose. You and we waive the right to a jury trial and to bring or join a class or representative action. Either party may bring an individual claim in small claims court instead. You may opt out of this arbitration agreement by emailing info@insurehealthplans.com within 30 days of first agreeing to these Terms.
These Terms are governed by California law, without regard to conflict-of-law rules, and by the Federal Arbitration Act. If any part is found unenforceable, the rest remains in effect.
We may update these Terms by posting a new version on this page with a new "Last updated" date. Changes apply to use of the Site after they are posted.
